TRADE PROMOTION: GAME OF CHANCE

SCHEDULE

 TERMS AND CONDITIONS

1. These Terms and Conditions include and should be read together with the Schedule for this Promotion. If there is any inconsistency between these Conditions and the Schedule, the Schedule will take precedence. By participating in the Promotion, you agree to comply with these Terms and Conditions.
2. Any capitalised terms used in these Conditions have the meanings outlined in the Schedule.

Eligibility

1. Entry to the Promotion is open to Australian residents in the Relevant State/s who meet the Eligible Entrant requirements.
2. Employees and immediate family members of the Promoter, its affiliates, distributors, stockists, and advertising partners are not eligible.

Entry

1. The Promotion will be conducted during the Promotion Period.
2. To enter the Promotion, entrants must complete the Entry Procedure during the Promotion Period.
3. Entries must be submitted following the Entry Procedure and will not be accepted if submitted in any other way. Automated or computer-generated entries are not allowed. Once an entry is submitted, it cannot be changed or withdrawn.
4. Participating retailers are defined by those that feature the Promotion merchandising in-store or are actively advertising the Promotion on their social media or website.
5. Participants who purchase a Promoter product during the Promotion Period from a non-participating retailer will not be eligible to take part in the Promotion.
6. Participants may enter the Promotion up to the Maximum Number of Entries if they want another chance to win. Multiple entries must each have separate transactions and must each separately meet any product purchase requirement specified in the Entry Procedure.
7. Promotion prizes are available to be won in-store during the Promotion Period. Products purchased outside the Promotion Period, or after Total Prizes Won Per Store or Scratch & Win Cards Per Store have run out, participants will not be eligible for any prize claims.
8. The Promotion is conducted fairly and honestly to all participants.
9. All prizes are limited in quantity and are awarded on a ‘first come, first served’ basis during the Promotion Period.
10. Maximum Scratch & Win Cards, Scratch & Win Cards Per Store, Total Participating Stores, Odds of Winning, Maximum Number of Entries and Stock Limits are disclosed in the Schedule.
11. Approximate Odds of Winning and Stock Limits will be available on Promotion materials and in-store.

Winner Determination and Prizes

1. Prize claims are redeemed from individual participating retailers in-store and instantly after a successful Scratch & Win card, not from the Promoter directly.
2. Each Scratch & Win card will reveal and determine which prize the participant will receive. See the Prize Details section in the Schedule for more prize details.
3. Winners will be notified as specified under section Winner Notification, Verification and Delivery in the Schedule.
4. Prizes are non-transferable and cannot be exchanged for cash, vouchers, or alternative products.
5. We reserve the right to substitute any prize with an alternative of equal or greater value should the allocated prize stock become unavailable.
6. The prizes are specified in the Prize Details. The Total Prizes Won Per Store, Total Prizes to be Won, Total Prize Pool Value (RRP), Prize Redemption, and Prohibited Prizes are specified in the Schedule.

Dispute Resolution

1. All disputes or queries regarding the Promotion must be submitted in writing within the time frame listed under the Prize Dispute Submission section of the Schedule. The Promoter will attempt to resolve all disputes in good faith.

Advertising and Terms Access

1. Participants can access the Terms and Conditions via the method outlined in the Schedule. A copy of the Promotion Terms & Conditions is available in-store at participating retailers on request.

Facebook and Instagram Disclaimer

1. This Promotion is being run in stores and will be promoted across selected social media platforms. This Promotion is in no way sponsored, endorsed, administered by, or associated with Facebook or Instagram.
2. Participants acknowledge that any information they provide in connection with this Promotion is provided to the Promoter only and not to Facebook or Instagram.
3. Any questions, comments, or complaints regarding the Promotion must be directed to the Promoter and not to Facebook or Instagram.
4. Participants release Facebook and Instagram, including their parent companies and affiliates, from any liability in connection with this Promotion.

Legal and Promotion Conditions

1. The Promotion is void where prohibited or restricted by law. Participant rights under the Australian Consumer Law remain unaffected.

2. The Promoter reserves the right to verify entries and disqualify any deemed fraudulent or non-compliant.

3. Except for any liability that cannot be excluded by law, the Promoter, its licensees, and marketers (including its officers, employees, contractors, and agents) exclude all liability (including negligence) for any personal injury, loss or damage, (including loss of opportunity), whether direct, indirect, special, or consequential, arising in any way out of the promotion, including but not limited to the following:

• Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control).
• Any theft, unauthorised access, or third-party interference.
• Any entry or prize claim that is late, altered, or lost.
• Use of the prize.

4. By participating in the Promotion, participants grant the Promoter and their affiliates the irrevocable right to the use of their name, likeness, and participation for promotional purposes or any photo, video, image and/or audio recording tagged on social media during the Promotion Period, in any medium, media or marketing material, whether now or later developed, at no charge to the Promoter.

5. Where applicable, the Promoter will use and protect personal data in compliance with applicable data protection laws.

6. Any false information provided within the context of the Promotion by any entrant concerning ownership of right, or non-compliance with these terms and conditions may result in the immediate disqualification of the participant.

7. The Promoter reserves the right to modify or cancel the Promotion if circumstances beyond its control arise.

8. If, for any reason, any aspect of this Promotion are not capable of running as planned, including because of computer virus, communications network failure, bugs, tampering, unauthorised intervention, fraud, technical failure or any cause beyond the control of the Promoter. The Promoter may, in its sole discretion, cancel, terminate, modify or suspend the promotion and invalidate any affected participants or suspend or modify a prize, subject to State or Territory regulation.

By participating in the Promotion, participants confirm that they have reviewed and understood these Terms and Conditions, and their participation in the Promotion signifies acceptance of these entry requirements.
